LaNet acceptable use policy

General

LaNet customers are solely responsible for the content they transmit, post, distribute, or otherwise make available using LaNet services.

LaNet customers agree to observe the acceptable use policy of any other network the customer accesses via LaNet services. LaNet customers are expected to be responsible for their use of the network and avoid actions that cause interference to the network or cause interference with the work of other on the network.

Prohibited Activities
LaNet services may be used only for lawful purposes. Uses described below are prohibited under this Policy. The descriptions are guidelines and are not intended to be exhaustive.

Transmission, distribution, or storage of any material in violation of any applicable law, regulation, or State of Louisiana Policy is prohibited. These activities include, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constituters an illegal threat, or violates export control laws.

System and Network Security
LaNet services may not be used in connection with attempts to violate the security of a network, service, or other systems. Examples of prohibited activities include hacking, cracking into, monitoring, or using systems without authorization; scanning ports, conducting denial of service attacks, and distributing viruses or other harmful software.

Email
Sending unsolicited bulk mail messages including, without limitation, commercial advertising and informational announcements, is explicitly prohibited by Louisiana Revised Statutes, Title 14 - Criminal Law, Section 73.6. A user shall not use another site's mail server to relay mail without the express authorization of the site. Unauthorized use, or forging of mail header information (e.g. "spoofing") is prohibited.

Notification
Each LaNet customer is responsible for the activities of its users and by accepting service from OTM, is agreeing to ensure that its users abide by this policy. Complaints regarding Illegal Activities or System or Network Security issues should be sent to OTM Network Operations Center at otm-noc@listserv.doa.la.gov. Complaints regarding email abuse should be sent to otm-abuse@la.gov.

Consequences
Violations of this policy may result in a demand for immediate removal of offending material, immediate temporary or permanent filtering, blocked access, suspension or termination of service, or other action appropriate to the violation, as determined by LaNet Network Operations management. When feasible, notice will be given so that violations may be addressed voluntarily; however, OTM Network Operations reserves the right to act without notice when necessary, as determined by OTM Network Operations and OTM management. OTM may involve, and will cooperate with, law enforcement if criminal activity is suspected. Violators may also be subject to civil or criminal liability under applicable law. Refunds or credits are not issued in connection with actions taken for violations of this policy.
